The company Miretti S.r.l., taxpayer identification number and VAT number 08010180159, with its registered office in Milan (Mi), Via Paolo Sarpi, as the Controller of the personal data processing pursuant to Legislative Decree 101/2018 and to Regulation EU 679/2016 – General Data Protection Regulation, or “GDPR” (hereinafter the Privacy Code and the GDPR) acknowledges the importance of the protection of personal data and considers such protection one of the principal aims of its activities.

Before communicating any personal data, Miretti S.r.l. asks you to carefully read this privacy policy (the “Privacy Policy”), since it contains important information on the security measures adopted to guarantee the confidentiality of the data in full compliance with the Applicable Regulations.

1. CONTROLLER AND DATA PROTECTION OFFICER

In light of the Applicable Regulations, the controller of the site’s processing operations is Miretti S.r.l., as defined in more detail above.

2.    THE PERSONAL DATA SUBJECT TO PROCESSING

“Personal Data” is understood to be any information regarding an identified or identifiable natural person.

A natural person is considered identifiable when he or she can be directly or indirectly identified, with particular reference to an element such as a name, identification number, data regarding his or her location, an online username or one or more characteristic elements of his or her physical, physiological, mental, economic, cultural or social identity.

The following Personal Data is collected by the Site:

a. Navigation data

During their normal operations, the computer systems and software procedures that manage the functioning of this web site acquire some personal data whose transmission is implicit in the use of the relevant Internet communication protocols.

This is information that is not collected to be associated with identified data subjects, but that by its very nature, through processing and associations with data held by third parties, could allow for the identification of the users.

This category of data includes IP addresses or the domain names of the computers used by the users who connect to the site, addresses in URI notation (Uniform Resource Identifier) of the resources requested, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment.

This data is used only in order to obtain anonymous statistical information on the use of the site and to monitor its proper functioning; the data is kept for 6 months and then deleted. The data could be used to determine liability in the case of potential computer crimes to the detriment of the site or of third parties, and is deleted after 6 months.

b. Data provided voluntarily

Through the Site, you have the possibility to voluntarily provide Personal Data such as your first name, last name, city and e-mail address to contact Miretti through the “Contact” form.

Miretti will process this data in accordance with the Applicable Regulations, assuming that the data refers to you or to third parties who have expressly authorized you to provide the data on a legitimate legal basis that justifies the processing of the data in question.

With respect to that possibility, you act as an independent data controller, assuming all of the obligations and liability under law.

In that regard, you provide the broadest release with respect to any objections, claims, requests for compensation for damages due to the processing, etc., that may be received by Miretti from third parties whose Personal Data has been processed through your use of the Site in violation of the Applicable Regulations.

c. Cookies and similar technologies

3.    PURPOSES, LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING

The Personal Data you provide through the Site will be processed by Miretti for the following purposes:

a) the execution of a contract to which you are a party or the execution of pre-contractual measures on your request (e.g. request for contact through Contact form, etc.);

b) research and statistical analysis regarding the aggregate or anonymous data, thus without the possibility to identify the user, aimed at measuring the functioning of the Site, measuring the traffic and evaluating usability and interest;

c) compliance with a legal obligation incumbent on Miretti;

d) actions necessary to determine, exercise or defend a right in a legal venue, or any time the legal authorities exercise their functions;

The legal basis of the Personal Data processing operations for the purposes in point a) is the provision of a service or the response to a request that do not require consent under the Applicable Regulations.

The purpose in point b) does not entail the processing of Personal Data, while the purpose in point d) represents legitimate processing of Personal Data pursuant to the Applicable Regulations, since once the Personal Data is provided, the processing is in fact necessary to comply with a legal obligation incumbent on Miretti.

The provision of your Personal Data for the purposes listed above is optional, but failure to provide the data could make it impossible to respond to your request or comply with a legal obligation incumbent on Miretti.

4. RECIPIENTS

Your personal data may be shared for the purposes specified in point 3, with:  

a) the entities necessary for the provision of the services offered by the Site, including, but not limited to, the sending of e-mail and the analysis of the functioning of the Site; those entities typically act as data processors for Miretti.

b) the persons authorized by Miretti who are bound to confidentiality or have an adequate legal confidentiality obligation (e.g. Miretti’s employers and associates), and legal authorities in the exercise of their functions when required by the Applicable Regulations.

6. PRESERVATION OF THE DATA

Miretti will process your Personal Data for the time strictly necessary to reach the purposes indicated in point 3.

Without prejudice to the above, Miretti will process your Personal Data for the time allowed by Italian law to protect its interests.

More information regarding the period of preservation of the Personal Data and the criteria used to determine that period can be requested by writing to the e-mail address of the Data Controller as indicated in article 1.

7. YOUR RIGHTS

Within the limits of the Applicable Regulations, you have the right to ask Miretti at any time for access to your Personal Data, the rectification or deletion of the same, or to oppose the processing, limit the processing and obtain the data that regards you in a structured, commonly-used and machine readable format.

Pursuant to the Applicable Regulations, you may in any event file a complaint with the competent oversight authority (the Personal Data Protection Authority) if you believe that the processing of your Personal Data is in conflict with the applicable regulations.

8. AMENDMENTS

This Privacy Policy went into effect on 1/10/2018. The Miretti company reserves the right to amend it or simply update its contents, in part or completely, including based on changes in the Applicable Regulations.

Miretti will inform you of any such changes as soon as they are introduced, and they will be binding as soon as they are published on the Site.
